第一次緊急全民大會續會

致香港公開大學全體學生:
本會已根據學生會會章第 21 條,於 2018 年 3 月 9 日下午 6 時召開緊急全民大會,親身出席的會員為 14 人,遠低於不足法定人數一百人,根據《會章》第 23 (b) 條「在預定會議召開時間半小時後仍不足法定人數時,主席須宣佈流會,並可於 14 天內再次召開⋯⋯」,故本席隨即宣布流會。
為保障與訟雙方的上訴權,本席決定在2018 年 3 月 16 日下午 6 時假何文田正校園郭得勝樓0樓楊雪姫演講廳(C座P01室)召開緊急全民大會。若在該次會議召開時間半小時內,登記之會員數目仍然不足法定人數一百人,本席須宣布流會。而按照本會《會章》「⋯⋯如再度流會,議案將自動撤銷。」
本席在此再此代表與訟雙方懇請各位同學在百忙中撥冗出席是次緊急全民大會,讓控辯雙方皆有合理和公平的審訊過程,從而在學生會的司法系統內彰顯法治和程序公義,令罪有應得的人治罪,還無辜者清白,這都是與公眾切身利益攸關。

如全民大會的地點有任何更改,本會會另函通知。是次大會的法定人數為 100 名親身出席的會員,希望各位同學能夠踴躍出席,提出自己的意見。如果未能出席,同學亦可將相關意見電郵至 sucouncil@ouhk.edu.hk(主旨「週年全民大會-發表意見」),本會將整合同學的意見,於緊急全民大會舉行當日向與訟雙方進行提問。

Dear all students,
In accordance with Article 21 of the Students' Union Consitution, the Union Council had held an emergency general meeting at 6 pm on March 9, 2018. There were 14 members who attended in person, far below the requirement of the Consitution that "The quorum of a general meeting shall be no less than 100 members present in person." According to Article 23(b) of the Consitution, "Whilst a quorum is not reached present within half an hour of a general meeting at the designated time, the meeting shall be adjourned upon the announcement of the Chairperson of the general meeting and an adjourned meeting may be re-convened within 14 days..." Therefore, I immediately announced the meeting was being adjourned.
In order to protect the right of appeal of both parties, I decided to hold an emergency general meeting at Serena Yeung Lecture Theatre (P01, Block C) on the 0th floor of Kwok Tak Seng Building, Homantin Campus, at 6 pm on March 16, 2018. If the quorum is not reached present within half an hour of a re-convened general meeting at the designated time, the constitution stated that "...If the second meeting is again adjourned, the motion shall be withdrawn of its own accord."
On behalf of both parties, I hereby urge all of you to attend the emergency general meeting at your busy schedule. This will allow both the prosecution and the defendant to have a fair and reasonable hearing process in order to demonstrate the rule of law and procedural justice in the Union’s judicial system. The community has a vested interest in the proper conduct of its prosecutions and in furthering the criminal justice imperative that the guilty are convicted and the innocent are acquitted. Those who sin and innocent people are vital to the public interest.

If there is any change in the location of the general meeting, the Union Council will notify you by mass email. The quorum for this Emergency General Meeting is 100 members who are present in person. The Union hopes that students can participate actively and give us your opinions on this opportunity. If you cannot attend the meeting, please kindly give your opinions through this email sucouncil@ouhk.edu.hk (heading as “Questions of the EGM”). We will arrange the questions and raise the questions for you during the session.
